Welcome to Xona ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Xona website, mobile site, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree, please stop using the Service.

1. Overview

Xona is a creative AI agent that helps you refine your ideas and turn them into reality through intelligent image generation. The platform uses the X402 protocol to enable pay-per-generation using USDC on the Solana blockchain, including automatic refunds for failed generations.

Xona is currently in Beta. Features, payment flows, and pricing may change over time.

2. Eligibility

  • Be at least 13 years old
  • If under 18, have parental or guardian consent
  • Have the legal capacity to enter into these Terms

3. Wallet and USDC Funding

a. Wallet Creation & Connection (via Privy)

  • Wallet creation and connection is handled by Privy, a trusted third-party authentication provider.
  • You can create a new wallet or connect an existing wallet through Privy's secure interface.
  • You retain full control of the funds stored in your wallet.
  • Xona does not store, access, or manage your private keys — all keys are securely managed by Privy.

b. Funding the Wallet

  • You may deposit USDC (on Solana) into your wallet at any time.
  • Wallet balances:
    • Are used solely to pay for image generations
    • Do not represent deposits, investments, or interest-bearing accounts

c. Payment with User Consent (X402 Pay-Per-Generation)

  • All transactions require your explicit consent before execution.
  • When you approve a generation, a USDC payment is processed via the X402 protocol.
  • If the generation succeeds → the payment settles
  • If the generation fails → the payment is automatically refunded

No credits. No subscriptions. No risk. Full control.

4. Payments and Pricing

  • All payments are processed in USDC via X402 or other supported Solana payment methods.
  • Network fees, blockchain delays, or third-party service interruptions are outside our control.
  • Pricing, supported assets, and payment methods may change without notice.

5. Generated Content

a. Ownership

  • You own the images you generate, subject to:
    • The terms of the AI model provider
    • Applicable laws and these Terms

b. License to Xona

  • You grant Xona a limited license to store and display your generated images for:
    • Delivering the service (showing your images to you)
    • Improving model performance (e.g., internal quality evaluation)
  • We do not sell or publish your generated content without your consent.

c. Content Restrictions

  • You may not generate or upload content that:
    • Contains explicit, hateful, violent, or illegal material
    • Infringes on intellectual property (copyright, trademarks, likeness rights)
    • Violates applicable law or platform policy
  • We may remove or disable access to content at our discretion.

6. Acceptable Use

  • You agree not to:
    • Abuse the platform using bots or automation
    • Attempt to reverse engineer or bypass limits
    • Misrepresent your identity or impersonate others
    • Use the platform for phishing, scams, or malicious activity
  • Violations may result in account suspension or permanent termination.

7. Data and Privacy

By using Xona, you agree to our Privacy Policy.

We collect minimal data necessary to operate the platform, such as:

  • Wallet address (public)
  • Generation activity
  • Usage analytics

We do not store private keys or seed phrases. All wallet operations are securely managed by Privy, and every transaction requires your explicit consent.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

  • We do not guarantee:
    • Continuous uptime or uninterrupted access
    • Accuracy or suitability of generated outputs
    • Price stability or availability of blockchain networks or tokens

You use the Service at your own risk.

9. Limitation of Liability

  • To the fullest extent permitted by law, Xona shall not be liable for:
    • Loss of funds due to network errors, wallet misuse, or user negligence
    • Indirect, incidental, or consequential damages
    • Fluctuation in value of USDC or any other asset used on the platform

10. Modifications

  • We may update or change any part of the Service or these Terms at any time. If changes materially affect your use of the Service, we will notify you.

11. Termination

  • We may suspend or terminate access to the Service if:
    • You violate these Terms or platform rules
    • You engage in abusive, fraudulent, or illegal activity
  • Unused wallet balances may be forfeited in cases of fraud or policy abuse.

12. Governing Law

  • These Terms are governed by the laws of Indonesia, or the operating jurisdiction of Xona.
  • Any disputes shall be resolved in the courts of that jurisdiction.
